All charges payable to Facilitykart by customer on consummated transactions final and non-refundable.
Facilitykart accepts payment only after the successful delivery of service, if customer registers any issue pertaining to same delivered service within the 7 days of delivery date; in that case Facilitykart will only be responsible for re-correcting/repairing the exactly same issue which was delivered earlier within a maximum period 6-7 working days. Facilitykart will not be issuing any cash refund to its customer.
Disclaimer of Warranties
Facilitykart provides seven (7) days warranty of services with limited liability of rework only. Whether the work falls in the scope of warranty is at the sole discretion of Facilitykart based on the outcome of inspection of Service provided.
NEITHER FACILITYKART NOR ITS AFFILIATES OR LICENSORS WARRANT THAT THE SERVICE IS FREE FROM VIRUSES, WORMS, TROJAN HORSES, OR OTHER HARMFUL COMPONENTS.
FACILITYKART AND ITS AFFILIATES AND LICENSORS CANNOT AND DO NOT GUARANTEE THAT ANY PERSONAL INFORMATION SUPPLIED BY YOU WILL NOT BE MISAPPROPRIATED, INTERCEPTED, DELETED, DESTROYED OR USED BY OTHERS.
Billing and Payment Policy
Facilitykart Customers are obligated to pay for the Services, unless specifically notified otherwise. Facilitykart Customers can pay using Internet Banking and/or credit/debit cards (“Bank Account”) or Wallet through Facilitykart’s payment gateway partners or could just pay the Facilitykart Service Provider in cash after the Service is completed. Facilitykart Customer can also pay at the end of a completed Service transaction. For all purchases and payments for reimbursement costs, fees or expenses associated with a Service, Facilitykart will charge your Bank Account according to the amount agreed upon between you and Facilitykart for the use of the Service Facilitykart retains the right, in its sole discretion, to place a hold on any payment for a completed Service transaction.
While Facilitykart will use commercially reasonable efforts to ensure the security of all banking and other personal information, we expressly disclaim any liability for any damage that may result should any information be released to any third parties, and you agree to hold Facilitykart harmless for any damages that may result therefrom. Facilitykart will use third party services to process banking information. For further information regarding that Services, please contact Facilitykart to request information about Facilitykart’s internet banking and other cashless transaction providers.
You will be liable for all transaction taxes on the services provided under this Agreement (other than taxes based on Facilitykart’s income).
Modifications to the Service
Facilitykart reserves the right in its sole discretion to review, improve, modify or discontinue, temporarily or permanently, the Service or any content or information on the Service with or without notice. Facilitykart will not be liable to any party for any modification or discontinuance of the Service.
Cancellation Policy
Customer shall be entitled to cancel your order at least 60 minutes prior to the service delivery time slot chosen by customer or Facilitykart at the time of complaint booking.
Booking cancellation cannot be accepted if the technician has reached at customer’s doorstep, in that case customer needs to pay the mandatory visit charge to the technician
We reserve the sole right to cancel your order in the following circumstance:
(i) in the event of the designated address following outside the serviceable area offered by us;
(ii) failure to contact you by phone or email at the time of confirming the order booking;
(iii) If no technician / service partner is available on the time of scheduled booking
(iii) failure to deliver your order due to lack of information, direction or authorization from you at the time of delivery; or
(vi) failure due to reasons beyond our control or attributable to the Vendor.
No Liability
You agree not to hold facilitykart, its affiliates, its licensors, or any of such parties, agents, employees, officers, directors, corporate partners, or participants liable for any damage, suits, claims, and/or controversies (collectively, “liabilities”) that have arisen or may arise, whether known or unknown, relating to your use of or inability to use the service, including without limitation any liabilities arising in connection with the conduct, act or omission of any user (including without limitation stalking, harassment that is sexual or otherwise, acts of physical violence, and destruction of personal property), any dispute with any user, any instruction, advice, act, or service provided by facilitykart or its affiliates or licensors and any destruction of your information.
Under no circumstances will facilitykart its affiliates, its licensors, or any of such parties’ agents, employees, officers, directors, corporate partners, or participants be liable for any direct, indirect, incidental, consequential, special or exemplary damages arising in connection with your use of or inability to use the services, even if advised of the possibility of the same.
If, notwithstanding the foregoing exclusions, it is determined that facilitykart or its affiliates, its licensors, or any of such parties’ agents, employees, officers, directors, corporate partners, or participants is liable for damages, in no event will the aggregate liability, whether arising in contract, tort, strict liability or otherwise, exceed the total fees paid by you to facilitykart during the three (3) months prior to the time such claim arose.
Changes to this Agreement and the Service
Facilitykart reserves the right, at its sole and absolute discretion, to change, modify, add to, supplement or delete any of the terms and conditions of this Agreement (including the Privacy Policy(http://www.facilitykart.com/document/privacy-policy/ )at any time, effective with or without prior notice. If any future changes to this Agreement are unacceptable to you or cause you to no longer be in compliance with this Agreement, you must terminate, and immediately stop using, the Service. Your continued use of the Service following any revision to this Agreement constitutes your complete and irrevocable acceptance of any and all such changes. Facilitykart may change, modify, suspend, or discontinue any aspect of the Service at any time. Facilitykart may also impose limits on certain features or restrict your access to parts or all of the Service without notice or liability.
I HEREBY ACKNOWLEDGE THAT I HAVE READ AND UNDERSTAND THE FOREGOING TERMS OF USE AND THE FACILITYKART PRIVACY POLICY AND AGREE THAT MY USE OF THE SERVICE IS AN ACKNOWLEDGMENT OF MY AGREEMENT TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS AGREEMENT.
